Force Majeure (Uncontrollable Events) : Freewell Industry Company Ltd shall not be liable for any delay or failure to perform resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, transportation delays, government actions, supply chain disruptions, or failures of third-party service providers.

10. Errors, Shortages, Incorrect Orders, Missing Items, or Damaged Goods Any visible damage, missing items, shortages, or incorrect products must be reported to us within 24 hours of delivery. Failure to report such issues within this timeframe may affect our ability to investigate and resolve the claim. This requirement does not limit or exclude any rights you may have under applicable consumer protection laws.

12. Shipping Invoice and Customs: Prices listed on shipping invoices are provided for customs declaration purposes. Import duties, taxes, and customs clearance fees are the responsibility of the recipient. Freewell Industry Company Ltd does not guarantee customs clearance and is not responsible for delays, seizures, or additional charges imposed by customs authorities. If customs authorities request supporting documentation, please contact us promptly for assistance.

13. Cancellation: Should the Buyer cancel the order due to a change of mind, or for any reason not attributable to an issue on our part, any non-refundable payment processing fees charged by the payment gateway, such as Airwallex or Stripe, will be deducted from the refund. These fees are charged by the payment gateway and are not charged or retained by us.

14. Product Images: Product images on the website are for representation purposes and may have slight differences from the final product.

15. Currency: All prices are listed in USD.

16. Affiliate Program Integrity and Abuse Prevention

To protect the integrity of the Freewell Affiliate Program and ensure fair participation for all affiliates, we reserve the right to monitor affiliate activity for compliance with these Terms. 

Affiliates must be creators or bloggers within Freewell Gear's product category, with valid social media accounts or active blog accounts. Affiliates must not engage in deceptive, manipulative, or unauthorized practices, including but not limited to:

• Intercepting, overwriting, or modifying affiliate links without clear user intent

• Using browser extensions, coupon injections, pop-ups, iframes, or similar technologies that alter attribution unfairly

• Misrepresenting Freewell, our products, pricing, or promotions

• Generating artificial, fraudulent, or misleading traffic, clicks, or conversions

• Posting affiliate links on cashback or coupon sites or running Ads that affects Freewell's PPC & Bidding.

Freewell reserves the right to review traffic sources, referral methods, and link placement at any time, including requesting reasonable information from the affiliate regarding how and where affiliate links are used.

If, at our reasonable discretion, an affiliate is found to be acting in bad faith, abusing the program, or violating these Terms:

• We may suspend or terminate the affiliate account immediately

• We may withhold, cancel, or revoke unpaid commissions associated with such activity

• We may permanently disqualify the affiliate from future participation

Termination or commission withholding will be limited to cases of clear violation, abuse, or misuse of the affiliate system and will be applied proportionately.

Freewell’s decisions under this section will be made in good faith and in accordance with applicable laws and regulations.

17. Review Guidelines: We encourage all customers to leave helpful, product-related reviews. Reviews should focus on the product’s features, performance, and quality. Any reviews containing personal attacks, offensive language, or unrelated content may be removed at our discretion. We appreciate genuine feedback, as it helps us improve and serve you better.

18. Limitation of Liability: To the fullest extent permitted by applicable law, Freewell Industry Company Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, arising out of or related to the use of this website, products, or services. Our total liability for any claim shall not exceed the amount paid by you for the product or service giving rise to the claim.
